US Supreme Court Takes Case of Colorado Business Owner

Colorado Law and Lower Court Would Force Business Owner to Go Against Her Conscience in Anti-1st Amendment Ruling

The US Supreme Court takes up the Case of Lorie Smith. A lower Federal Court had ruled against Freedom of Speech and Freedom of Religion in the case. The ruling went against Lorie, a Web Development business owner, saying Colorado can force her to promote messages that violate her conscience. The case was then appealed to the US Supreme Court and CCRF again filed an Amicus Brief.

Sacramento County District Attorney Tried To Prosecute Those Arrested

On May 1, 2020, the people rose up in support of freedom. The President and the Governor had promised that 60 days to stop the spread of the virus. However, 60 days had come and gone. The virus, while devastating to the old and infirmed was a bid cold for the general population yet the Governor had closed restaurants, solons, gyms and government offices throughout California. Governor Newsom had declared some workers as essential, public safety employees, marijuana businesses, movie companies were exempt from the mandates.

This mandate seemed unfair to many and on May 1, 2020, the Freedom Angels applied for a permit to demonstrate at the California Capitol in Sacramento. Governor Newsom would not allow protests in violation of his orders and ordered CHP to deny the permit application.

Regardless, thousands showed up to protest the Governor orders to shut down California. 36 protesters were arrested for peacefully protesting at the Capitol, The California Constitutional Rights Foundation attorneys stepped in to defend 32 of those arrested.

After notice to the Sacramento County District Attorney that the arrests violated the 1st Amendment right to peacefully protest, the District Attorney declined to prosecute those arrested.

Foundation attorney Steven Bailey said, “The California Constitutional Rights Foundation was proud to stand with patriots who are willing to oppose the overreach of out-of-control politicians.”
